Terms & Conditions

Please read these terms carefully before engaging Obmondo's services — they govern how we work together, from confidentiality and intellectual property to liability and data protection.

General Terms

EnableIT ApS ("Obmondo") operates in accordance with applicable Danish and European Union (EU) laws, including but not limited to intellectual property, data protection, and contract law. Obmondo provides IT support services and software development, focusing on large-scale operations. By engaging Obmondo's services, the customer acknowledges and accepts these terms and conditions.

Confidentiality & Non-Disclosure Agreements (NDA)

Obmondo respects the confidentiality of its customers' data and operational details. While some customers may request an NDA, Danish law already provides reasonable protection of confidential information. Nevertheless, Obmondo may agree to sign a separate NDA upon request, provided that such an agreement does not conflict with its open-source or legal commitments.

Intellectual Property & Copyright

Under EU law, the copyright of any code, configuration, or software developed by Obmondo remains the exclusive property of Obmondo. This includes but is not limited to:

  • Any IT solutions, software code, or configurations created by Obmondo.
  • Any improvements, modifications, or enhancements made during the provision of IT support services.

Unless otherwise agreed, Obmondo releases the products of our work as open-source and shares the work using a public Git platform. The primary open source projects we contribute to is KubeAid and LinuxAid, which are licensed under the AGPL-3 (GNU Affero General Public License v3.0).

Service Engagement & Contractual Terms

Obmondo does not impose specific contractual obligations on customers beyond those established by Danish and EU law. Customers engaging with Obmondo accept that:

  • Services are provided on an as-needed basis, where Obmondos work is initiated by the receipt of an alert from the customers' systems or a support request from the customers' employees.
  • Any code or configuration, unless otherwise agreed, is shared under Obmondos open source projects and remains the intellectual property of Obmondo and may be incorporated into its open-source projects.
  • Subscriptions are billed by the month, and can be terminated by the customer whenever they want to, which will cause support of the server or Kubernetes cluster without subscription to no longer be monitored or supported, by the end of its current subscription period.
  • Subscriptions are non-refundable.

Liability & Warranty Disclaimer

Obmondo provides IT support and software development services on an "as is" basis, without any warranties, express or implied. To the maximum extent permitted under applicable law:

  • Obmondo is not liable for any indirect, incidental, or consequential damages resulting from the use of its services or software.
  • Obmondo does not guarantee the uninterrupted availability or error-free performance of its open-source projects.

Data Protection & Compliance

Obmondo adheres to the General Data Protection Regulation (GDPR) and relevant Danish data protection laws. Customers are responsible for ensuring compliance with GDPR when using Obmondo's services. Obmondo will issue a Data Processing agreement should the customer want this in writing.

Governing Law & Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of Denmark. Any disputes arising from the engagement with Obmondo shall be subject to the exclusive jurisdiction of the Danish courts.
